Mr. Mangum, from the Committee on Naval Affairs, to whom was referred, on the 30th December last, the nomination of Edmund L. Dubarry, reported.

On motion by Mr. Mangum,

Ordered, That the said nomination lie on the table.

Mr. Huntington, from the Committee on Commerce, to whom was referred, on the 4th instant, the nomination of William H. Freeman, reported.

Whereupon

Resolved, That the Senate advise and consent to his appointment, agreeably to the nomination.

The Senate proceeded to consider the nomination of Charles H. Dupont.

On motion by Mr Mangum.

Resolved, That the Senate advise and consent to the appointment of Charles H. Dupont, agreeably to the nomination.

The Senate resumed the consideration of the nomination of James M. Barker; and,

After debate,

On motion by Mr. Buchanan that the further consideration of the nomination of James N. Barker be postponed to Friday next, the 18th instant,

On motion by Mr. Evans,

The yeas and nays being desired by one-fifth of the Senators present,

Those who voted in the affirmative are,

Messrs. Allen, Archer, Benton, Buchanan, Calhoun, Fulton, King, Linn, McRoberts, Pierce, Styler, Smith of Connecticut, Sturgeon, Tappan, Walker, Woodbury, Wright, Young.

Those who voted in the negative are,

Messrs. Barrow, Bates, Berrien, Choate, Clay, Clayton, Evans, Graham, Henderson, Huntington, Kerr, Mangum, Miller, Morehead, Phelps, Porter, Preston, Simmons, Smith of Indiana, Southard, Tallmadge, White, Woodbridge.

The question then recurred, Will the Senate advise and consent to the appointment of James N. Barker?

And

On motion by Mr. Mangum,

The yeas and nays being desired by one-fifth of the Senators present,

So it was

Resolved, That the Senate do not advise and consent to the appointment of James N. Barker to be First Comptroller of the Treasury, vice Walter Forward, appointed Secretary of the Treasury.

Mr. Buchanan submitted the following motion for consideration:

Resolved, That the nomination of James N. Barker as Comptroller of the Treasury has not been rejected by the Senate on account of any belief that his official conduct in the case of the Swartwout defalcation was negligent or improper.

On motion by Mr. Pierce,

Ordered, That the injunction of secrecy be removed from the vote of the Senate on the rejection of the nomination of James N. Barker.
