Senate Executive Journal --SATURDAY, May 24, 1828.
The following message was received from the President of the United States, by Mr. John Adams, his Secretary:
To the Senate of the United States:
Washington, May 24th, 1828.
I nominate Peter B. Porter, of New York, to be Secretary of War.
James Webb, of Florida, to be Judge of the Southern Judicial district, in the Territory of Florida.
William Allison McRea, of Florida to be Attorney of the United States, for the Southern Judicial district in said Territory.
Henry Wilson, of Florida, to be Marshal for the said Southern Judicial district.

Adam Gordon, of Florida, to be Marshal of the district of West Florida, in the place of Henry Wilson, transferred.
James G. Ringgold, of Georgia, to be Attorney of the United States for the Middle district of Florida, in the place of William A. McRea, transferred.
Beaufort T. Watts, of South Carolina, to be Secretary of Legation at St. Petersburg.
Edward T. Tayloe, of Virginia, to be Secretary of Legation to the Republic of Colombia.
JOHN QUINCY ADAMS.
The message was read.
The Senate proceeded to consider the nominations for appointments in the Marine Corps, contained in the messages of the 22d instant; and
Resolved, That they advise and consent to the appointments of William Anderson, Theodore Bainbridge, Joseph L. Kuhn, Park G. Howle, and Elijah J. Weed, agreeably to their respective nominations.
The Senate proceeded to consider the nomination of William H. Harrison, contained in the message of the 22d instant; and
Mr. Benton being, at his request, excused from voting,
It was
Resolved, That the Senate advise and consent to the appointment of William H. Harrison, agreeably to the nomination.
On motion by Mr. Hayne,
The Senate resumed the consideration of the nomination of Alexander Macomb, contained in the message of the 15th April.
On motion by Mr. Eaton,
That the nomination lie on the table,
It was determined in the negative: Yeas, 18; Nays, 19.
On motion by Mr. Chambers,
The yeas and nays being desired by one-fifth of the Senators present,
Those who voted in the affirmative, are--Messrs. Barnard, Branch, Chandler, Cobb, Eaton, Ellis, Foot, Hayne, Johnston, of Louisiana, McLean, Macon, Parris, Rowan, Silsbee, Smith, of Maryland, Tazewell, Tyler, and Williams.
Those who voted in the negative, are--Messrs. Barton, Bateman, Benton, Bouligny, Chambers, Chase, Hendricks, King, McKinley, Marks, Noble, Ridgely, Robbins, Ruggles, Seymour, Van Buren, Webster, Willey, and Woodbury.
On the question, "Will the Senate advise and consent to the appointment of Alexander Macomb?
It was determined in the affirmative: Yeas, 26; Nays, 12.
On motion by Mr. Thomas,
The yeas and nays being desired by one-fifth of the Senators present,

Ordered, That the injunction of secrecy be removed from the proceedings on the nomination of Alexander Macomb.
The following message was received from the President of the United States, by Mr. John Adams, his Secretary:
To the Senate of the United States:
Washington, May 24th, 1828.
I nominate Lewis Cass, of the Territory of Michigan, and Pierre Menard, of Illinois, Commissioners to treat with the Indians under the act this day passed to enable the President of the United States to hold a treaty with the Chippewas, Ottawas, Potawatamies, Winnebagoes, Fox, and Sac nations of Indians.

The message was read, and, by unanimous consent, considered.
Resolved, That the Senate advise and consent to the appointments of Lewis Cass, and Pierre Menard, agreeably to their respective nominations.
Mr. Benton, from the Committee on Military Affairs, to whom were referred the nominations for promotion and appointments in the Army, contained in the messages of the 22d instant, reported. Whereupon,
Resolved, That the Senate advise and consent to the appointments of Charles Dimmock Sibley, W. Maynadier, Lucian J. Bibb, Burk, A. J. Pleasanton, John Child, James Moses E. Merrill, Ephraim K. Smith, and Edmund Kirby, agreeably to their respective nominations.
