<p>And the said defendants come and defend the force and injury, when and say plaintiffs actio non because they say the are no guilty, in manner and form as charged in the declaration, and of this they put themselves upon the county

<p>And for further plea in this behalf said defendants say actio non because

they say that at the time when in the declaration mentioned the supposed dwelling house in said declaration mentioned was a common disorderly and ill governed house, within which, by the permission and procurement of the said plaintiffs, drunkenness, idleness, quarrelling, profane swearing, obscenity, and other offensive acts and noises were then and there, and for a long time previous thereto, had been , practiced and encouraged to the great injury and annoyance of the peaceful citizens of the neighborhood, insomuch that the same had become and then and there was, a public nuisance; wherefore the said defendants did destroy the spirituous liquors therein found, and did some other acts, not now than was necessary for the abatement of said nuisances, as lawfully they might for the cause aforesaid; and which are the supposed trespasses in the declaration mentioned and this they are ready to verify; wherefore they pray judgment</p>
